1. About these Terms
1.1. These Terms of Use ("Terms") govern your use of HeyBeet, the web service at heybeet.com ("HeyBeet", the "Service"). The Service is provided by Dmytro Shylovskyi, running a sole proprietorship registered in CEIDG (Poland), Aleja Pokoju 81E/86, Kraków, Poland, NIP 6751833407, email[email protected] ("we", "us").
1.2. By creating an account or buying a plan you agree to these Terms. If you do not agree, please do not use the Service.
1.3. How we handle your personal data is described in our Privacy Policy, which is part of these Terms.
2. The Service
2.1. HeyBeet helps you eat in a more heart-friendly way, following the DASH eating pattern. It consists of:
- a free quiz about your goals and eating habits, which builds a personal plan in your browser;
- for paying users, a dashboard where you photograph or upload a meal and get an estimate of its nutrients (calories, sodium and others), a Heart Score from 1 to 10 and a suggested swap, plus a history of your scans.
2.2. The Service runs in a modern web browser and needs an internet connection. There is no mobile app yet.
2.3. To keep the Service available for everyone, each account can scan up to 30 meals in 24 hours. Your scans are kept until you delete them or your account.
2.4. We are actively developing HeyBeet and may add, change or remove features. We will not remove the meal scan, which is what you pay for, during a period you have already paid for; if we ever stop offering it, section 8.4 applies.
3. Not medical advice
3.1. HeyBeet is a wellness tool. It is not a medical device and does not diagnose, treat or prevent any condition. The Heart Score, nutrient estimates, plans and tips are general information about food, not medical advice, and they do not replace your doctor's advice or your treatment plan.
3.2. Do not change your medication, your treatment or a diet your doctor prescribed because of something HeyBeet showed you. Talk to your doctor first, especially if you have high blood pressure, kidney disease, diabetes or another condition, are pregnant, or take medication.
3.3. If you feel unwell or think you may have a medical emergency, contact a doctor or your local emergency number straight away.
4. How the meal analysis works
4.1. Meal photos are analysed by artificial intelligence models from third-party providers (see thePrivacy Policy). The analysis estimates what is on the plate and how much; the Heart Score is then calculated from those estimates by a fixed set of rules.
4.2. A photo cannot show everything: salt, oil, sauces and portion size are often hidden. The results areestimates and can be wrong. You can answer a few questions after a scan and correct the dish name, meal type, calories and salt, and the Heart Score updates accordingly. We do not guarantee that any estimate is accurate.
4.3. The analysis and the Heart Score have no legal or similarly significant effect on you.
5. Your account
5.1. You must be at least 18 years old to create an account or buy a plan.
5.2. Your account is created with your email address on the quiz's email step or when you pay. You log in with one-time links we send to that email; there is no password. Keep access to your email secure: anyone who can read it can log in to your account. Tell us at once at [email protected] if you think someone else has used your account. You can log out of all devices from your dashboard.
5.3. An account is for one person and may not be shared, sold or transferred.
5.4. Please give a correct email address. If you mistype it, we cannot send you login links or reach you.
6. Plans, prices and payment
6.1. Access to the dashboard requires a paid plan. The plans, their prices and their exact terms are shown on the plans page at the end of the quiz before you pay, in the currency of the version of the site you use. What you see there, together with these Terms, is your contract with us.
6.2. Subscriptions renew automatically at the end of each period (for example every week, month or year, as shown on the plans page) at the price shown there, until you cancel (section 7).
6.3. Welcome discount. A discount offered in the quiz applies to the first period of a subscription only. Renewals are charged at the full price shown on the plans page.
6.4. Paid trial. Some plans start with a short trial for a small fee paid today. Unless you cancel before the trial ends, your subscription starts automatically when it ends and you are charged for the first period, then the full price for each following period, as shown on the plans page.
6.5. Lifetime plan. A one-time payment, where offered, gives access for as long as we provide the Service, with no renewals.
6.6. Payments are processed by Stripe. You enter your card or other payment details in Stripe's payment form; we never see or store them. Stripe sends you a receipt after each payment.
6.7. Reminders. We send you an email before your trial ends and before each renewal, so you have time to cancel.
6.8. If a renewal payment fails, Stripe may retry it. If it still cannot be collected, your subscription ends and so does your access.
6.9. We may change the price of a plan. A new price never applies to a period you have already paid for. If the price of your subscription changes, we will tell you by email at least 30 days before your first renewal at the new price, and you can cancel before it applies.
7. Cancelling
7.1. You can cancel your subscription at any time:
- with the link to manage your subscription in the reminder and receipt emails from Stripe; or
- by writing to [email protected] from your account's email address; we cancel it within one business day and confirm by email.
7.2. Cancelling stops future renewals. You keep access until the end of the period you have already paid for, and nothing more is charged. If you cancel during a trial, the trial runs to its end and you are not charged for the first period.
7.3. Deleting your account (section 10.3) also cancels your subscription.
8. Money-back guarantee and refunds
8.1. 30-day money-back guarantee. If you are not happy with HeyBeet, write to[email protected] within 30 days of your first payment. We refund in full everything you paid in those 30 days (the trial fee and the first period, or a lifetime purchase), no questions asked, and end your plan. We send the refund to the card or account you paid with within 14 days of your request.
8.2. The guarantee covers your first purchase. Later renewals are not refundable, except where section 8.3 or the law requires it. Cancelling (section 7) stops the next renewal.
8.3. Your statutory rights. If you are a consumer in the European Union, you have the right to withdraw from a contract concluded online within 14 days without giving a reason. To withdraw, send us a clear statement by email to [email protected]. Our money-back guarantee gives you at least the same: a full refund for 30 days from your first payment. Nothing in these Terms limits the rights you have under the consumer law of your country.
8.4. If we stop providing the meal scan, we will tell you by email at least 30 days in advance and refund the unused part of any subscription period you have paid for.
9. Your photos and our content
9.1. The photos you upload stay yours. You allow us to store and process them, including with the AI providers named in the Privacy Policy, only to provide the Service to you: analysing the meal and showing it in your scan history.
9.2. Upload only photos of food that you are allowed to share. Do not upload photos of people, documents or anything unlawful. We may delete content that breaks this rule.
9.3. HeyBeet itself, including its name, logo, design, texts, images, quiz, Heart Score rules and software, belongs to us or our licensors. While you have an account we give you a personal, non-exclusive, non-transferable licence to use the Service for your own, non-commercial purposes. You may not copy, resell or redistribute the Service or its content.
10. Using the Service fairly
10.1. You agree not to:
- try to get unauthorised access to the Service, other accounts or our systems;
- use bots, scripts or other automated means to scan meals or access the Service, or try to get around the scan limit;
- copy, reverse engineer or resell the Service or the results it gives you;
- overload, disrupt or interfere with the Service;
- use the Service for anything unlawful, harmful or fraudulent.
10.2. If you seriously or repeatedly break these Terms, we may suspend or close your account. Unless the law or the risk of harm prevents it, we will tell you why by email first and give you a chance to respond. If we close a paying account for a reason that is not your breach of these Terms, we refund the unused part of your paid period.
10.3. You can stop using HeyBeet at any time. To delete your account and your data, write to[email protected] from your account's email address; you can delete single scans yourself in your dashboard.
11. Our responsibility
11.1. We provide the Service with reasonable care and skill, but we cannot promise that it will always be available, uninterrupted or free of errors, or that it will lead to any particular health result. We may need to pause it for maintenance or updates.
11.2. We are not responsible for losses that were not reasonably foreseeable, for losses caused by your internet connection or device, or for events beyond our reasonable control.
11.3. Apart from section 11.4, our total liability to you is limited to the amount you paid us in the 12 months before the event that caused the loss.
11.4. Nothing in these Terms limits or excludes our liability for damage caused intentionally or through gross negligence, for death or personal injury caused by our negligence, or any other liability that cannot be limited or excluded by law, including your rights as a consumer.
12. Changes to these Terms
12.1. We may update these Terms, for example when we add features or when the law changes. We will publish the new version on this page with a new date at the top.
12.2. If a change affects you materially, we will tell you by email at least 30 days before it applies. If you do not agree, you can cancel your plan before then; changes never apply to a period you have already paid for.
13. Law and disputes
13.1. These Terms are governed by Polish law. If you are a consumer, this does not take away the protection of the mandatory consumer law of the country where you live.
13.2. If something goes wrong, please write to us first at [email protected]. We answer complaints within 14 days.
13.3. If we cannot settle it together, you can take the dispute to the competent court. As a consumer you can always bring proceedings in the courts of the country where you live. Consumers in Poland can also get free help from their local consumer ombudsman (rzecznik konsumentów) or the Trade Inspection (Inspekcja Handlowa), and consumers in other EU countries from their national consumer centre.
14. Other terms
14.1. If any part of these Terms is found invalid, the rest stays in force.
14.2. If we do not enforce a right straight away, we can still enforce it later.
14.3. You may not transfer your rights under these Terms to someone else without our consent. We may transfer ours to a new owner of HeyBeet, provided your rights are not reduced.
14.4. These Terms are written in English. If we provide a translation, the English version applies, unless the law of your country gives you a better right.
